Terms of Service

Last updated November 1, 2026

Please read these terms carefully. The most important points: HomeBadger is a research tool built on public records that can be wrong, it is not legal or investment advice, you must verify everything with the county clerk before bidding, and paid plans renew automatically until you cancel.

1. Agreement to these terms

These Terms of Service (“Terms”) are an agreement between you and HomeBadger LLC (“HomeBadger”, “we”, “us”) and govern your use of the HomeBadger website, our MCP server and any other services we provide (together, the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you use the Service for a company, you agree on its behalf and confirm you have authority to do so.

2. Who can use the Service

You must be at least 18 years old and able to form a binding contract. The Service is intended for users in the United States and covers Florida properties. You may not use the Service if you are barred from doing so under applicable law or if we have previously terminated your account.

3. Accounts and organizations

Keep your login details confidential and accurate. Each account is for one person; do not share it. You are responsible for activity under your account, including activity by AI apps you connect. Tell us promptly at [email protected] if you suspect unauthorized access.

Plans belong to an organization. The organization's owners and admins manage its members, invitations and billing, and the organization owner is responsible for its members' use of the Service and for paying for its plan. Seats are limited by plan.

4. Plans, billing and cancellation

  • Free plan. The Free plan is free and has the features and limits shown on our pricing page. We may change Free plan features at any time.
  • Paid plans. Paid plans are billed in advance, monthly or annually, through our payment processor Stripe, using the payment method you provide. Prices and features are shown on the pricing page at the time you subscribe.
  • Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You authorize us (through Stripe) to charge your payment method for each renewal.
  • Cancellation. You can cancel at any time in Billing. Cancellation takes effect at the end of the current billing period; you keep paid features until then, and you are not charged again.
  • Refunds. Payments are non-refundable and we do not provide refunds or credits for partial billing periods, unused features or downgrades, except where required by law or where we say otherwise in writing.
  • Price changes. We may change prices. We will give you at least 30 days' notice by email before a price change applies to your subscription, and it will take effect at your next renewal after the notice period. If you do not agree, you can cancel before then.
  • Failed payments. If a payment fails, Stripe may retry it. If it still cannot be collected we may downgrade the organization to the Free plan.
  • Taxes. Prices do not include taxes unless stated. You are responsible for applicable taxes, which we may collect where required.

5. Acceptable use

You agree not to:

  • Scrape, crawl, bulk-download or systematically copy the Service or its data, other than through features we provide (such as exports on plans that include them) and within their limits.
  • Resell, sublicense, publish or redistribute the Service's data, or use it to build a competing product or dataset.
  • Circumvent plan limits, rate limits, access controls or security measures, or share accounts to avoid paying for seats.
  • Reverse engineer, decompile or interfere with the Service, or introduce malware or excessive load.
  • Use the Service to harass, threaten, defraud or exploit anyone, including property owners, borrowers or other people named in public records.
  • Use the Service, or any data from it, as a factor in determining anyone's eligibility for credit, insurance, employment, housing or tenancy, or for any other purpose covered by the Fair Credit Reporting Act. HomeBadger is not a consumer reporting agency and its data is not a consumer report.
  • Contact property owners or other people in ways that break the law. If you contact them, you are responsible for complying with all applicable laws, including the Telephone Consumer Protection Act, do-not-call rules, the Fair Debt Collection Practices Act, CAN-SPAM and Florida laws on foreclosure rescue and surplus-funds recovery.
  • Use the Service for anything unlawful or in violation of these Terms.

6. Connected AI apps, API and MCP access

You can connect HomeBadger to AI apps such as Claude or ChatGPT through our MCP server. When you approve a connection, the app acts on your behalf, with your plan's access and only the permissions you approved, including changing your watchlists if you allow it. You are responsible for the apps you authorize and for what you ask them to do. You can disconnect an app at any time in Connected apps.

  • Connected apps are subject to rate limits (currently 60 requests per minute per app) and to the acceptable-use rules above. Using an AI app or script to scrape or bulk-copy data is not allowed.
  • We may change, limit or discontinue the MCP server or its tools, and we may revoke tokens or block an app to protect the Service or our users.
  • The AI app is provided by a third party (for example Anthropic or OpenAI) under its own terms and privacy policy. We are not responsible for the AI app, how it uses or presents HomeBadger data, or what it says.

7. Data accuracy and no professional advice

HomeBadger compiles information from public records and third-party sources, including county clerk auction and court websites, property appraiser tax rolls, statewide parcel data and property valuation providers. These sources can be incomplete, out of date or wrong, and auctions are frequently cancelled, rescheduled or changed up to the moment of sale. Property values, equity figures, expected winning bids and auction predictions are estimates produced by models and can be significantly off.

The Service is for research and informational purposes only. It is not legal, financial, tax, title or investment advice, and we are not a broker, lender, title company or law firm. Before you bid, verify every detail with the county clerk, review the court file, get an independent title search and make your own decision, with professional advice where appropriate. You are solely responsible for your bidding and investment decisions.

8. AI-generated content

Some features use artificial intelligence, for example to read court documents and summarize lien types, judgment amounts, parties and risk flags. AI output can be inaccurate or incomplete: it may miss a risk, flag something that isn't one, or misread a document. Treat it as a starting point, check it against the source documents, and don't rely on it as the only basis for any decision.

9. Intellectual property

The Service, including our software, design, compilation and organization of data, estimates, scores and the HomeBadger name and logo, belongs to us or our licensors and is protected by law. Public records themselves are not ours, but our compilation of them is. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own internal research during your subscription.

You keep ownership of what you add, such as notes and saved searches (“your content”). You give us a limited license to store and process your content only to provide and improve the Service for you.

If you send us feedback or suggestions, we may use them without any obligation to you.

10. Third-party services

The Service relies on and links to third-party services, such as Stripe for payments, map and photo providers, and county clerk websites. Your use of those services is governed by their terms, and we are not responsible for their content, availability or practices.

11. Suspension and termination

You can stop using the Service and ask us to delete your account at any time (see the Privacy Policy). We may suspend or terminate your access, or revoke connected-app tokens, if you breach these Terms, if your use creates risk or legal exposure for us or others, or if we discontinue the Service. Where reasonable, we will notify you first. If we terminate a paid plan without cause, we will refund the unused portion of any prepaid fees. Sections that by their nature should survive termination (including payment obligations, disclaimers, limitation of liability, indemnity and governing law) survive.

12. Disclaimers

THE SERVICE AND ALL DATA, ESTIMATES AND AI OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY DATA IS ACCURATE, COMPLETE OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO SOME MAY NOT APPLY TO YOU.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEBADGER LLC AND ITS OWNERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, INVESTMENT OR BUSINESS OPPORTUNITY, INCLUDING LOSSES FROM BIDDING ON OR BUYING ANY PROPERTY, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR US$100. THESE LIMITS APPLY TO EVERY THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

14. Indemnity

You will defend, indemnify and hold harmless HomeBadger LLC and its owners and employees from any claims, damages, losses and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your contact with property owners or other people, your bidding or investment activity, or your breach of these Terms or the law.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Before filing a claim, you agree to try to resolve the dispute informally by emailing [email protected] with a description of the issue; we will do the same. If it is not resolved within 30 days, either of us may bring a claim in the state or federal courts located in Florida, and both of us consent to their jurisdiction. Either of us may bring a qualifying claim in small claims court.

16. Changes to these terms

We may update these Terms. We will show the new date at the top and, for material changes, notify you by email or in the app at least 14 days before they take effect. If you keep using the Service after the changes take effect, you accept them; if you do not agree, stop using the Service and cancel your plan.

17. General

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for delays caused by events beyond our reasonable control. Nothing in these Terms creates a partnership, agency or employment relationship.
